Terms of Service
Acceptance of terms
These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "user") and Savvy Dollar ("Savvy Dollar", "we", "us", or "our"), governing your access to and use of the Savvy Dollar application and website at savvydollar.io (together, the "Service").
By registering for an account, accessing the Service, or clicking to accept these Terms, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
About Savvy Dollar
Savvy Dollar is a personal finance planning application that helps users set savings goals, track debt payoff progress, and organise their money using a virtual bucket system. The Service allows you to:
- Create and manage savings and debt payoff goals ("Buckets");
- Manually enter your own financial data to track progress;
- Connect to third-party financial data providers to import account and transaction information (where that feature is enabled); and
- View insights and projections based on the information you provide.
Important: Savvy Dollar is a financial planning and goal-tracking tool, not a licensed financial adviser, credit provider, or bank. Nothing in the Service constitutes financial advice. See Section 7 for our full disclaimer.
Eligibility
To use the Service you must:
- Be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is greater);
- Have the legal capacity to enter into a binding contract; and
- Not be prohibited from using the Service under any applicable law.
If you are accessing the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms, and references to "you" include that entity.
The Service is available to users in Australia and the United States. We make no representation that the Service is appropriate or available in other locations. If you access the Service from outside those countries, you do so at your own risk and are responsible for compliance with local laws.
Your account
Registration
You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.
Account security
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must notify us immediately at support@savvydollar.io if you suspect any unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account.
One account per person
You may only hold one active account. You may not share, sell, or transfer your account to any other person.
Subscription plans & billing
Free tier
Savvy Dollar offers a free tier that includes access to a set of core features at no cost. The features available on the free tier are described on our pricing page and may change from time to time.
Premium plan
A premium subscription ("Premium") unlocks additional features and benefits beyond the free tier. Current Premium inclusions and pricing are displayed on the pricing page and may change with notice to you.
Billing & renewal
By subscribing to Premium you authorise us to charge your nominated payment method on a recurring basis at the applicable subscription interval (monthly or annual). Subscriptions automatically renew unless cancelled before the renewal date.
Cancellation
You may cancel your Premium subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not provide pro-rated refunds for partial periods unless required by applicable law.
Refunds
Except as required by law (including Australian Consumer Law), all fees are non-refundable. If you are an Australian consumer and you believe you are entitled to a remedy under the Australian Consumer Law, please contact us.
Failed payments
If a payment fails, we may attempt to re-charge your payment method and/or downgrade your account to the free tier. You remain responsible for any outstanding amounts.
Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service for any illegal, fraudulent, or deceptive purpose;
- Attempt to gain unauthorised access to any part of the Service or its infrastructure;
- Reverse engineer, decompile, or disassemble any part of the Service;
- Scrape, crawl, or extract data from the Service by automated means without our written consent;
- Introduce malicious code, viruses, or harmful data;
- Use the Service to transmit unsolicited communications;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity; or
- Use the Service in any way that could damage, disable, or impair its operation.
We reserve the right to suspend or terminate access for any user who violates this section.
Financial information disclaimer
Savvy Dollar is not a financial adviser. The Service provides tools to help you organise and track your own financial information. Nothing in the Service constitutes financial advice, investment advice, tax advice, legal advice, or any other professional advice.
Any projections, goal timelines, or insights generated by the Service are estimates based solely on the data you provide and are for informational purposes only. They are not guarantees of any outcome.
You should always seek independent professional advice from a qualified financial adviser, accountant, or other professional before making significant financial decisions. We are not responsible for any financial decisions you make based on information provided by the Service.
Where the Service connects to third-party financial data providers, the accuracy of that data depends on those providers. We do not verify the accuracy of imported data and are not responsible for any errors or omissions.
Data & privacy
Your privacy matters to us. Our Privacy Policy explains what personal information we collect, how we use and store it, and your rights in relation to that information.
Your data
You retain ownership of the financial data you enter into the Service. By using the Service, you grant us a limited licence to store and process that data for the sole purpose of providing the Service to you.
Financial account connections
Where you choose to connect a bank account or financial institution through a third-party data provider (such as an open banking provider), you authorise that provider to share your financial data with us on your behalf. We handle that data in accordance with our Privacy Policy. You may revoke this connection at any time through your account settings.
We do not store your bank login credentials. Access tokens provided by third-party data providers are stored securely and used only to retrieve the data you have authorised.
Australian users
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
US users
Where applicable, we comply with US federal and state privacy laws, including the California Consumer Privacy Act (CCPA/CPRA) for California residents. Please refer to our Privacy Policy for more detail.
Data deletion
You may request deletion of your account and associated data at any time by contacting us at support@savvydollar.io. We will process deletion requests in accordance with our Privacy Policy and applicable law.
Intellectual property
The Service, including all software, design, content, trademarks, and branding, is owned by Savvy Dollar and is protected by intellectual property laws in Australia, the United States, and internationally.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes in accordance with these Terms.
You may not copy, modify, distribute, sell, or sublicense any part of the Service without our express written permission. Nothing in these Terms transfers any intellectual property rights to you.
Third-party services
The Service may integrate with third-party services, including financial data providers, payment processors, and analytics platforms. These third parties have their own terms and privacy policies, which govern your use of their services.
We are not responsible for the availability, accuracy, or conduct of any third-party service. Your use of third-party services is at your own risk. We encourage you to review the terms and privacy policies of any third-party services you connect to Savvy Dollar.
Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content or data within the Service.
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot be excluded, restricted, or modified. Where we are permitted to limit our liability, our liability is limited to re-supplying the Service or paying the cost of re-supply.
Limitation of liability
To the maximum extent permitted by applicable law, Savvy Dollar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of savings, financial loss, or goodwill, arising out of or in connection with your use of or inability to use the Service, even if advised of the possibility of such damages.
To the extent we are liable for any loss or damage, our total aggregate liability to you in respect of any claim arising out of or in connection with these Terms or the Service shall not exceed the total fees paid by you to us in the three (3) months immediately preceding the event giving rise to the claim, or AUD $100, whichever is greater.
This limitation does not apply to liability that cannot be excluded or limited under applicable law, including liability under the Australian Consumer Law.
Indemnification
You agree to indemnify, defend, and hold harmless Savvy Dollar from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your access to or use of the Service;
- Your breach of these Terms;
- Any data or content you submit to the Service; or
- Your violation of any applicable law or the rights of any third party.
Termination
You may stop using the Service and close your account at any time by contacting us at support@savvydollar.io or through your account settings.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, if required by law, or if we decide to discontinue the Service.
On termination, your right to use the Service ceases immediately. Sections 7, 9, 11, 12, 13, 15, and this section survive termination.
Governing law & disputes
These Terms are governed by the laws of Queensland, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia for the resolution of any dispute arising under or in connection with these Terms.
If you are a US user, you also agree that disputes may be resolved in Australian courts, but we reserve the right to seek injunctive or other equitable relief in any jurisdiction.
Before commencing any formal dispute proceedings, we encourage you to contact us first at support@savvydollar.io so we can try to resolve the issue informally.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and/or by displaying a notice within the Service before the changes take effect. The updated Terms will show the revised effective date at the top of this page.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and close your account.
